GENERAL TERMS & CONDITIONS OF SERVICE

1. PREAMBLE & LEGISLATIVE COMPLIANCE
1.1. These Terms and Conditions ("The Agreement") constitute a binding legal contract between IcyPeaks ehf. ("The Company") and the purchasing entity or individual ("The Client").

1.2. Multi-Day Packages: Services lasting more than 24 hours or including overnight accommodation fall under the definition of a "Package" and are operated in strict accordance with the Icelandic Act on Package Travel and Linked Travel Arrangements No. 95/2018 (Lög um pakkaferðir).

2. NATURE OF SERVICE & FLEXIBILITY
2.1. Expedition Types:

• Day Expeditions: Private journeys lasting less than 24 hours without accommodation.
• Multi-Day Journeys: Bespoke itineraries spanning multiple days, including accommodation and logistical support.
  2.2. Itinerary Adjustments: In the Arctic environment, flexibility is essential. The Company reserves the right to alter routes, accommodation (to a similar standard), or schedules instantly if dictated by environmental safety, road closures, or official directives. Such alterations are made to ensure client safety and do not constitute a breach of contract.

3. BOOKING PROCESS & PAYMENT SCHEDULE
3.1. The Deposit: To initiate the reservation process, secure accommodation, and lock in private assets (guides/vehicles), a non-refundable deposit of 30% of the estimated total price is required.
3.2. No Booking Without Payment: Please note that IcyPeaks ehf. does not hold tentative reservations or book third-party services (such as luxury lodges or private flights) until this deposit has been received and cleared. Availability of specific properties (e.g., Deplar Farm, The Retreat) cannot be guaranteed until the deposit is processed.
3.3. Balance Payment: The remaining balance (70%) is due no later than 8 weeks (56 days) prior to the arrival date. Failure to remit the balance by this deadline may result in the cancellation of the booking and forfeiture of the deposit.
3.4. Last Minute Bookings: For reservations made less than 8 weeks prior to departure, full payment (100%) is required immediately upon booking.
3.5. Currency: All obligations are settled in Icelandic Króna (ISK).
3.6. Price Guarantee: For Multi-Day Journeys, the agreed price is fixed. However, in accordance with Art. 7 of Act 95/2018, The Company reserves the right to adjust pricing up to 20 days prior to departure solely due to direct changes in fuel costs, taxes, or exchange rates.

4. CANCELLATION & REFUND POLICY
4.1. Due to the strict cancellation policies of our ultra-luxury accommodation partners and the high demand for private assets, the following cancellation timeline applies:

A. DAY EXPEDITIONS (Single Day):

• Cancellation > 48 hours prior to departure: 100% Refund.
• Cancellation < 48 hours prior to departure: 0% Refund (Full charge applies).

B. MULTI-DAY JOURNEYS (Packages):

• Cancellation > 8 weeks (56 days) prior to departure: The 30% Deposit is retained by IcyPeaks ehf. as a service & booking fee. Any amount paid above the deposit is refunded.
• Cancellation between 56 days and 30 days prior to departure: 50% of the total trip cost is non-refundable.
• Cancellation < 30 days prior to departure: 100% of the total trip cost is non-refundable (0% Refund).

4.2. Specific Third-Party Conditions: Please be aware that certain ultra-luxury properties or private charters may have stricter cancellation terms (e.g., 90-day non-refundable clauses). In such specific cases, the third-party’s stricter policy supersedes standard IcyPeaks terms.
4.3. Processing Time: Applicable refunds will be processed to the original payment method within 14 days of cancellation.

5. UNAVOIDABLE CIRCUMSTANCES (Force Majeure)
5.1. In the event of "unavoidable and extraordinary circumstances" (e.g., volcanic eruptions, extreme weather alerts, road closures by Vegagerðin) occurring at the place of destination which significantly affect the performance of the tour:

• Right to Cancel: The Client may terminate the contract before the start of the package without paying any termination fee. In such cases, The Client is entitled to a full refund of payments made but not to additional compensation.
• Accommodation Liability: In the event that return transport is prevented by unavoidable circumstances, The Company’s statutory liability to provide accommodation is strictly capped at a maximum of three nights per traveller. Any costs incurred beyond this period are the sole responsibility of The Client. We strongly urge clients to claim such expenses primarily through their comprehensive travel insurance.

6. ASSUMPTION OF RISK & LIABILITY
6.1. Inherent Risk: The Client acknowledges that expeditions in Iceland involve inherent risks. By participating, The Client voluntarily assumes risks associated with off-road travel and glacial terrain.
6.2. Liability Limits: IcyPeaks ehf. is liable for the proper performance of travel services. However, we are not liable for failures attributable to The Client, unforeseeable third-party acts, or unavoidable extraordinary circumstances.
6.3. Insurance: The Client is strongly advised to possess comprehensive travel insurance covering cancellation, medical expenses, and repatriation.

7. CLIENT OBLIGATIONS
7.1. Safety Compliance: The guide retains Safety Authority. Participation may be denied to any client deemed unfit or lacking mandatory safety gear (e.g., hiking boots). In such cases, no refund will be issued.
7.2. Transfer of Booking: For Multi-Day Journeys, The Client may transfer the package to another person who satisfies all conditions applicable to the contract, provided reasonable notice (at least 7 days) is given to The Company.

8. PRIVACY & MEDIA
8.1. Discretion: We operate with strict discretion.
8.2. Media Usage: Unlike standard operators, IcyPeaks ehf. respects your right to privacy. We will not capture or publish imagery of The Client for promotional purposes without explicit written or verbal consent.

9. GOVERNING LAW
9.1. This Agreement is governed by Icelandic Law. Any dispute shall be subject to the exclusive jurisdiction of the District Court of Reykjavík (Héraðsdómur Reykjavíkur).
